BCDA Wants Peaceful Transition Or Another Legal Battle? #1MNews


Business people in the Philippines and even abroad are observing the Bases Conversion and Development Authority (BCDA) and Camp John Hay Development Corporation (CJH Dev Co) for a long time. Even ordinary citizens are wondering why these two are doing the never-ending legal battle when in fact every minute has a chance to discover the wealth in this world without hurting other people.

Unlike these two dragons that never ceased to slash each other throat just for claiming the Camp John Hay as the ultimate prize of the decade. That even the Arbitration Tribunal cannot fathom how to award them without firing shots with each other. Are they businessmen, lawyers, and individuals with weird characters or people with much power and money to control any situation without considering other people’s lives?

In the past, these two entities are rendering to develop and improve the Camp John Hay with energy. Like most businessmen, aiming for high revenues is one of the vital components of being successful. A married of partnership was sealed for this Camp John Hay thing.

Also like most lovers, financial difficulties evolved without warning and heartaches hurled to each other in which they separated with much emotion to revenge the process. Legal battle ensued with weapons coming nowhere were being used just smashed the opponent.

Lately, The Philippine Dispute Resolution Center, Inc., cast its decision to both CJHDevCo the Bases BCDA, ordering the developer, CJHDevCo to give up occupancy of the leased areas of the former military camp and the BCDA to return P1.42 billion as reimbursement for rental payments.

Arnel Paciano Casanova of the Bases Conversion and Development Authority (BCDA) proclaimed himself winner after the decades-long controversy over Camp John Hay (CJH) and Bob Sobrepena of CJHDevCo spread his stand of the case publicly. Which was why, BCDA unfold something fishy for the contracts done by CJHDevCo.

Arnel Casanova’s highly-publicized disputes not only with CJHDevCo but also with other private developers, such as SM Land Inc. in BGC, have long spooked the business community and dampened investor confidence in PPP projects and other big-ticket joint ventures with the government, despite the successive credit upgrades of the Philippine economy as Asia’s new growth haven.
Maltreating BCDA’s private partners and its other stakeholders may be partly in Casanova’s DNA, judging from his warlike behavior towards CJHDevCo, SMLI and even seemingly harmless active and retired military officers residing in a portion of the former Fort Bonifacio army camp at BGC.

Businesses and locators in the Camp John Hay area, the property in the middle of a contentious dispute between Camp John Hay Development Corp. (CJHDevco) and the Bases Conversion and Development Authority (BCDA), appear to be the real losers in legal battle of the two parties as the debate has now shifted to the validity of sub-lessees’ contracts.

The tribunal decision was just a start for Arnel Casanova to find ways to subdue the ruling and CJHDevCo’s stand which made him the arrogant public servant in the history of Philippine business world.

Whatever his reason, he should prioritize the development of Camp John Hay as public servant by the government of the Philippines.
