The Executive Power And The Judicial Branch: Is It Really Equal? #1MNews



In his latest SONA about DAP of the President Aquino, he reiterated his position about the Disbursement Acceleration Program as a system helping to hasten the process of development wherein vital government programs must be addressed in a shorter possible time. An excess or saving fund of the government that they want it to use for emergency like what they did when they used the funds during the calamities.

In other words, the Disbursement Acceleration Program (DAP) is a stimulus package under the Aquino administration designed to fast-track public spending and pushes economic growth. This covers high-impact budgetary programs and projects which will be augmented out of the savings generated during the year and additional revenue sources.

Funds used for programs and projects identified through DAP were sourced from savings generated by the government, the realignment of which is subject to the approval of the President; as well as the Unprogrammed Fund that can be tapped when government has windfall revenue collections, e.g., unexpected remittance of dividends from the GOCCs and Government Financial Institutions (GFIs), sale of government assets. This system was introduced by Secretary Butch Abad which his unaccepted resignation by the Aquino Administration fueled his detractors for more demonstrations.


The Supreme Court declared DAP as unconstitutional. But President Aquino told the Filipino people as constitutional according to 1987 Constitution. PNoy filed a motion of reconsideration (MR) but got rejected. He then continued to defend DAP in spite of the court ruling. He seems like wanting to prove the validity of DAP according to his understanding.

His words made his political critics and other leftist groups condemned as negative. They even planned to file impeachment complaints against him.

The media people were busy getting the side of Malacañang of whatever comments coming from different groups who nurtured their sides to be heard by Filipino people. It’s blockbuster news for some people and a damaging effect for our government at present. We don’t need this happen but at the rate of disgruntled Filipino citizens, it made life in a hanging stage.

Do all of these sectors of the Philippine society really know that the Executive, the Legislative and the Judiciary are co-equal in our government system? Of course, I can say that maybe some, but majority do not? According to Wikipedia, The Politics of the Philippines takes place in an organized framework of a presidential, representative, and democratic republic whereby the president is both the head of state and the head of government within a pluriform multi-party system. This system revolves around three separate and sovereign yet interdependent branches: the legislative branch, the executive branch, and the judicial branch. Executive power is exercised by the government under the leadership of the president. Legislative power is vested in both the government and the two-chamber Congress: the Senate (the upper chamber) and the House of Representatives (the lower chamber). Judicial power is vested in the courts with the Supreme Court of the Philippines as the highest judicial body.

While the President was eliminating bad elements on his present administration, he dismantled corrupt public officials including Chief Justice Corona and three Senators. He even doubling his effort to raise the GNP of the Philippines, and managing our country into the future globally.

Is this the result for his political agenda “Matuwid Na Daan” because of such action in PDAF resulting in opening up a “can of worms” called DAP?

President Aquino must prove his words to the Filipino people and create balance of power and authority by way of showing up his true self as a democratic President. Must listens to all the forces against his administration, study and take action according to the Law of the Land. It’s never easy but he’ll try his best to pacify the present political movement. It’s just a “Ripple” of “Tsunami?”

  2. Sorry dude, hindi ata SONA speech ni Pnoy yun. Sa July 28 pa ang SONA. But I agree with you, the Executive, Legislative and Judicial branches of the govt. is co-equal. So the Pres, MUST respect the SC ruling on DAP. Huwag ng ipagsiksikan na constitutional ang pet project nya.

  3. He should always remember that the Supreme Court has equal power as the Executive. If the high court has already spoken, he should follow it. He must move on and be productive in his last days in Malacañang.

  5. I agree, he keeps on defending that DAP is right but SC already voted 13-0 that DAP is not constitutional.

  6. Pnoy's intentions may be honorable but still questionable. We'll observe what happens when he continually insist on DAP.
